Terms of Service

These terms govern your access to and use of TheCarGo and any related software, websites, and services. Please read them carefully — by creating an account or using the service, you agree to them.
1. Agreement to terms
By accessing or using TheCarGo (the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these terms.
2. The service
TheCarGo provides software for auto transport brokers to manage leads, quotes, orders, dispatching, e-signature, and payments, including integrations with third-party load boards and payment processors. We may add, change, or remove features over time to improve the Service.
3. Accounts & eligibility
You must provide accurate account information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account and your users’ accounts. You must be at least 18 and able to form a binding contract.
4. Acceptable use
You agree not to misuse the Service — including attempting to access it without authorization, interfering with its operation, uploading unlawful content, or using it to violate the rules of connected load boards, carriers, or payment networks. We may suspend accounts that put the Service or other users at risk.
5. Customer data & ownership
You own the data you submit to the Service. You grant us a limited license to host, process, and transmit that data solely to provide and improve the Service. We do not sell your customer data. See our Privacy Policy for details on how data is handled.
6. Third-party integrations
The Service connects to third parties such as Central Dispatch, Super Dispatch, and payment processors. Your use of those services is governed by their own terms, and we are not responsible for their availability, accuracy, or actions. Integration behavior may change if a third party changes its systems.
7. Fees & billing
Paid plans include a platform license fee plus per-user fees, billed in advance on a recurring basis. Fees are non-refundable except where required by law. We may change pricing with prior notice; continued use after a change means you accept it.
8. Free start
We may offer a free introductory period for new customers. Paid fees begin when you choose to continue, or as agreed during onboarding.
9. Intellectual property
The Service, including its software, design, and trademarks, is owned by us and our licensors. These terms do not grant you any right to our intellectual property except the limited right to use the Service as permitted.
10. Disclaimers
The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that load board or payment integrations will always be available.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these terms or if required for legal or security reasons. On termination, you may export your data for a limited period as described in the Service.
13. Changes to these terms
We may update these terms from time to time. We will post the updated version with a new “last updated” date and, for material changes, provide additional notice. Your continued use means you accept the updated terms.
14. Governing law
These terms are governed by the laws of the state in which TheCarGo is organized, without regard to conflict-of-law rules. Disputes will be resolved in the courts located there, unless otherwise required by law.
